Plain-language summary: ABZ Learning gives users a limited right to play our games and use our educational resources for personal, home, tutoring, nonprofit program, and classroom instruction. Users must protect accounts, respect other people and intellectual property, avoid harmful or automated misuse, and obtain appropriate permission before providing a child's or student's information.
1. Acceptance of these terms
These Terms of Service (“Terms”) are a binding agreement between ABZ Learning (“ABZ,” “we,” “us,” or “our”) and the person or organization using the ABZ Learning website, games, accounts, educator dashboard, student portal, assignments, and related resources (collectively, the “Service”).
By accessing or using the Service, an adult user agrees to these Terms and our Privacy Policy. If an adult uses the Service on behalf of a school, district, company, nonprofit, family, or other organization, that adult represents that they have authority to accept these Terms for that organization.
If you do not agree, do not create an account, provide personal information, or continue using the Service.
2. Eligibility, children, and supervision
ABZ includes content intended for children, but the legal agreement for account-based use must be made by an adult, parent or legal guardian, or an authorized school representative.
- A child under 13 may use classroom or account features only with authorization from a parent or legal guardian, or through a school authorized to consent for the educational context.
- A child should not create an independent student account without parent or guardian permission.
- Parents, guardians, and educators are responsible for choosing age-appropriate activities, supervising use where appropriate, and reviewing third-party destinations before a child opens them.
- Users must provide accurate information about their role and must not pretend to be a parent, educator, school representative, or another person.

3. Accounts, credentials, and security
Some features require an educator account, class code, gamer tag, student profile, picture password, or other credential. Account holders are responsible for activity under their accounts and for keeping credentials reasonably secure.
- Use accurate account information and keep adult contact information current.
- Do not share educator credentials or permit students to use an educator account.
- Treat class codes, student names, gamer tags, and picture-password sequences as access information. Share them only with the intended student, caregiver, or authorized school personnel.
- Notify ABZ promptly if an account or classroom code may have been accessed without authorization.
- Do not create accounts in bulk through scripts, bots, or other automated methods.
ABZ may require a credential reset, remove an unsafe gamer tag or display name, or restrict an account when reasonably necessary to protect users or the Service. ABZ is not responsible for loss caused by a user's failure to protect credentials, except where applicable law provides otherwise.
4. Educator and school responsibilities
An educator, school, district, tutor, or program that creates student profiles, assigns work, or submits student information represents that it has the authority required to do so. This may include parent notice or consent, district approval, or another valid legal basis.
Educators and organizations agree to:
- use student information only for legitimate educational purposes;
- provide only information reasonably necessary to use the Service;
- avoid uploading sensitive information such as a home address, medical record, Social Security number, government identifier, or detailed special-education record;
- manage roster accuracy and deactivate or request deletion of accounts that are no longer needed;
- follow applicable school, district, child-privacy, student-privacy, and records-retention rules, including FERPA where it applies to the school;
- review whether linked or embedded third-party services are approved for the students who will use them; and
- contact ABZ before uploading student information if the organization requires a separate data-processing or school-service agreement.
These Terms do not make ABZ a “school official” under FERPA by themselves and do not replace a contract or data agreement required by a school or law.
5. Limited license to use the Service
Subject to these Terms, ABZ grants each user a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for lawful educational purposes. Educators, tutors, families, libraries, community programs, and nonprofit learning programs may display and use the Service with their learners.
Unless ABZ gives written permission, users may not:
- sell, sublicense, rent, or charge others specifically for access to ABZ content;
- copy or republish an entire game, question bank, website page, database, or substantial collection of ABZ material;
- remove copyright, brand, attribution, or rights notices;
- frame, mirror, or host the Service on another site in a way that suggests it is the user's product;
- reverse engineer, decompile, or extract source code except to the limited extent a law expressly allows and cannot be waived; or
- use ABZ content or data to train, evaluate, or develop a machine-learning model without written permission.
Downloading or printing is permitted only where the Service offers that function or ABZ clearly labels material as downloadable or printable.
6. User content and feedback
“User Content” means material a user submits, creates, saves, or sends through the Service, such as a custom question set, drawing, typed response, assignment note, support message, or feedback.
The user retains any ownership rights the user has in User Content. The user grants ABZ a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, and otherwise process User Content only as reasonably necessary to operate, secure, support, and improve the Service and comply with law. This license ends when the content is deleted from active systems, except for reasonable backup periods, de-identified information, and records ABZ must retain.
The user represents that the user has the rights and permissions needed to submit User Content and that it does not violate law, confidentiality duties, school rules, or another person's rights. Do not submit unnecessary personal information about a child or another person.
If a user voluntarily sends a suggestion or product idea, ABZ may use the idea without payment or obligation, but ABZ will handle personal information in the message according to the Privacy Policy.
7. Acceptable use
Users may not use the Service to:
- break a law, violate another person's rights, or encourage harmful conduct;
- harass, threaten, exploit, impersonate, or expose personal information about another person;
- submit unlawful, hateful, sexually explicit, violent, deceptive, infringing, or otherwise inappropriate content;
- probe, scan, bypass, or interfere with authentication, access controls, databases, security, rate limits, or network operation;
- introduce malware, malicious code, destructive files, or hidden tracking;
- scrape, crawl, harvest, or systematically copy the Service or user information without written permission;
- manipulate scores, assignments, progress, analytics, or leaderboards through cheating, automation, or falsified requests;
- use another person's account, class code, student profile, or credentials without authorization;
- send spam, advertising, or unrelated commercial messages; or
- use the Service in a way that creates an unreasonable burden or disrupts another user's learning.
ABZ may investigate suspected misuse and may preserve or disclose relevant information when reasonably necessary to protect users, the Service, or legal rights, consistent with the Privacy Policy and applicable law.
8. Privacy and student information
Our Privacy Policy explains the information ABZ collects, how it is used and disclosed, analytics and advertising practices, children's privacy, and available rights. It is incorporated into these Terms.
Schools and educators do not transfer ownership of student information to ABZ. ABZ will use school-provided student information to deliver the authorized educational Service, support users, secure the Service, and meet legal obligations. An educator or school may request access, correction, export, or deletion by contacting ABZ. A parent request may be directed through the school when the school controls the relevant education record.
No internet service can guarantee absolute confidentiality or security. Users should not submit information that is not necessary for learning or account operation.
9. Third-party services, media, and links
The Service may include or link to third-party services such as Firebase, Formspree, Google Analytics, Google AdSense, Grow, GIPHY, content-delivery networks, Netlify-hosted game experiences, and Roblox. Third parties may have separate accounts, terms, privacy policies, content rules, age requirements, or technical limitations.
ABZ does not control a third party's service, content, availability, data practices, or security. Opening a third-party service is at the user's discretion, and adults should review it before allowing a child to proceed. A link or integration does not mean ABZ endorses every item available through that provider.
Some games use popular-culture themes, media, or fan-oriented references. The owners of third-party names, characters, images, videos, GIFs, platforms, and trademarks retain their rights. Unless expressly stated, ABZ is not sponsored by, endorsed by, or affiliated with those owners.
10. ABZ intellectual property
The Service—including its original software, game mechanics and presentation, question banks, text, graphics, interfaces, page designs, compilations, and ABZ names and logos—is owned by ABZ or used under license and is protected by copyright, trademark, and other laws.
These Terms grant permission to use the Service; they do not transfer ownership. All rights not expressly granted are reserved. Users may not use ABZ branding in a way that suggests sponsorship, partnership, certification, or endorsement without written permission.
Copyright concerns
If you believe material on the Service infringes your copyright or another intellectual-property right, email abzonlinelearning@gmail.com with identification of the work, the material and URL at issue, your contact information, a statement of your good-faith belief, and any authority you have to act for the rights holder. We may request additional information needed to evaluate the notice.
11. Changes, updates, and availability
ABZ may add, remove, redesign, pause, or discontinue games, skill sets, account features, third-party integrations, or other parts of the Service. We may perform maintenance or release changes without notice when needed for security, reliability, legal compliance, or improvement.
We aim to keep the Service available and games working, but we do not promise uninterrupted access, permanent storage, backward compatibility, or continued availability of any specific game, media item, URL, score, assignment, or third-party integration. Users should keep separate copies of any custom content or records they are required to preserve.
ABZ may correct content, questions, scoring, descriptions, metadata, or technical errors. Educational content is a supplemental practice tool and does not replace an educator's professional judgment, an individualized education plan, formal assessment, or required curriculum.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” ABZ disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.
ABZ does not warrant that the Service will be uninterrupted, secure, error-free, compatible with every device, or free of harmful components; that every question, answer, grade label, standard reference, score, or report will be complete or error-free; or that use will produce a particular academic result.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent allowed by law. Nothing in these Terms limits non-waivable rights, including mandatory consumer protections.
13. Limitation of liability and indemnity
To the maximum extent permitted by law, ABZ and its owners, personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, goodwill, or opportunity; or the acts, content, downtime, or data practices of a third-party service.
To the maximum extent permitted by law, ABZ's total liability arising from the Service or these Terms will not exceed the greater of (a) the amount the claimant paid directly to ABZ for the Service during the 12 months before the event giving rise to the claim or (b) US $100. These limits do not apply where liability cannot lawfully be limited, including certain liabilities for intentional misconduct or personal injury.
An adult user or organization agrees, to the extent permitted by law, to defend and indemnify ABZ from third-party claims and reasonable costs arising from that user's or organization's unlawful use, User Content, violation of these Terms, or violation of another person's rights. This obligation does not apply to a child and does not require indemnity for ABZ's own unlawful conduct.
14. Suspension and termination
A user may stop using the Service at any time and may request account deletion as described in the Privacy Policy. ABZ may suspend, restrict, or terminate access when we reasonably believe a user has violated these Terms, created risk or harm, misused student information, threatened security, failed to maintain required authorization, or exposed ABZ or another person to legal liability.
When reasonable, ABZ will provide notice and an opportunity to correct the problem. We may act immediately where needed to protect a child, user, account, database, or the Service; comply with law; or respond to serious abuse.
Sections that by their nature should survive termination—including intellectual property, disclaimers, liability limitations, dispute provisions, and rights concerning previously submitted content—will continue to apply.
15. Disputes and general terms
Informal resolution
Before filing a formal claim, an adult user and ABZ agree to make a good-faith effort to resolve the issue by email. Send a description of the concern and requested resolution to abzonlinelearning@gmail.com. This does not prevent either party from seeking urgent relief or using a process that law makes available.
Applicable law
These Terms are governed by applicable law, without applying rules that would require the law of another jurisdiction. Mandatory consumer, child-privacy, and student-privacy rights remain available regardless of this provision. Nothing here requires a school or government entity to accept a governing-law or venue term it is legally unable to accept.
General provisions
- Entire agreement: These Terms and the Privacy Policy are the agreement concerning general use of the Service, unless ABZ and an organization sign a separate agreement that controls a specific subject.
- Severability: If a provision is unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will continue.
- No waiver: A failure to enforce a provision is not a waiver of the right to enforce it later.
- Assignment: A user may not transfer these Terms or an account without written permission. ABZ may transfer them in connection with a reorganization or transfer of the Service, subject to applicable privacy law.
- No agency: These Terms do not create an employment, partnership, joint venture, franchise, or agency relationship.
- Headings: Headings are for convenience and do not change the meaning of a provision.
16. Changes to these terms and contact
ABZ may update these Terms as the Service or law changes. We will post the revised Terms here and update the effective date. If a material change requires additional notice or consent, we will provide it as required by law. Continued use after revised Terms take effect means the adult user accepts them; if the user does not agree, the user should stop using the Service.
